WHAT IS THE ENFORCEMENT OFFICER ENFORCING AND HOW DOES (s)he proceed?
First, it's important to understand what a civil infraction is. Legally speaking, MCL 600 Sec. 113. explains it (1) As used in this act: (a) "Civil infraction" means an act or omission that is prohibited by a law and is not a crime under that law or that is prohibited by an ordinance, as defined in section 8701, and is not a crime under that ordinance, and for which civil sanctions may be ordered. Simply speaking, it is a non-criminal violation of a rule, ordinance or regulation.
Second, the township is authorized by our Civil Infractions Ordinance to ticket violators of an ordinance. For example, if someone is allowing junk to accumulate in their yard or setting of fireworks illegally, they can be cited by the township. A citation in itself will not land the violator in jail nor will it appear as a criminal record; however, it will cost the violator money or perhaps even involve a court case if there are repeated or contested violations.
